In order to officially let the IRS know you intend to treat your business as an s-corp, you need to file a 2553. If it is 75 days after the creation of your business entity (llc or inc), we will need to include a Form 8832 as well.
The Forms 2553 and 8832 that declare the start date of your S-Corp election must be ink signed, as electronic signatures and efiling are not currently permitted. Please print single-sided the "Unsigned - Form 2553 Late S-Election" (and "Unsigned - Form 8832 with Late Election Relief" if applicable) uploaded to your Formations account, sign & date the following pages, then return to us:
If it is within 75 days of your business entity being created, once you ink-sign the form, you can upload that back to us as this form can be faxed to the IRS. If we have asked for the 2553 and 8832, we need those both mailed to us.
